Hourmere

Terms of Service

Effective date: October 16, 2026

These Terms of Service ("Terms") govern your use of the Hourmere website at hourmere.com and of Hourmere Cloud, the hosted Hourmere service, including its API and remote MCP server (together, the "Service"). The Service is provided by Cobaltmere, LLC, a Delaware limited liability company ("Cobaltmere", "we", "us"). For Hourmere, these Terms replace the general Terms of Service at cobaltmere.com/terms.

By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you agree to these Terms on its behalf and confirm that you have the authority to do so.

Hourmere is in development and Hourmere Cloud is not available yet. These Terms will apply to Hourmere Cloud when it opens. Until then, they apply to your use of this website.

1. The Service

Hourmere is scheduling software. It lets you share booking links so that invitees can pick a time that works, syncs with Google Calendar and Microsoft 365, sends email confirmations and reminders, provides an embeddable booking widget, and offers an API and a remote MCP server so that AI assistants and other applications can work with your schedule.

2. Open-source software and self-hosting

The Hourmere software is being developed as open source under the GNU Affero General Public License v3.0 (AGPL-3.0). Your use, modification and distribution of the software, including running your own Hourmere instance, is governed by that license, not by these Terms. If you run your own instance, you are its operator and are responsible for it, including the data it holds and its connections to calendar providers. These Terms apply only to the Service that we operate.

3. Accounts

You must give accurate information when you create an account and keep access to your sign-in methods, such as your email account, secure. You are responsible for activity under your account, including activity by users you invite and by applications you authorize. You must be at least 18 years old, or the age of majority where you live if that is higher, to use Hourmere Cloud.

4. AI agents, the API and the MCP server

  • You can authorize AI assistants and other applications to use your account through the API or the remote MCP server with an API key that you create. OAuth authorization for AI connectors is planned. Actions that applications take with your API key, such as booking, rescheduling or cancelling meetings, are treated as actions taken by you.
  • Keep your API keys secret. If you think a key has been misused, revoke it right away.
  • AI assistants can make mistakes. Check important bookings, and do not give API keys to applications you do not trust. AI assistants are provided by third parties, and we are not responsible for their actions or output.
  • We may apply rate limits and usage limits to the API and the MCP server to keep the Service reliable for everyone.

5. Calendar connections

When you connect a Google or Microsoft calendar, you authorize Hourmere to access it as described in our Privacy Policy. You can disconnect a calendar at any time. Your use of Google and Microsoft services remains subject to their own terms.

6. Your data and your invitees

  • You keep all rights to the data that you and your invitees submit to the Service ("Customer Data"). You grant us a limited license to host, process and transmit Customer Data only as needed to provide, secure and support the Service. Our handling of personal data is described in our Privacy Policy.
  • If you need a data processing agreement, for example under the GDPR, we will provide one on request at privacy@cobaltmere.com.
  • You decide what information your booking pages ask invitees for. You are responsible for having the right to collect and use that information and for complying with the laws that apply to you. Do not use booking questions to collect payment card numbers, passwords or government identification numbers.
  • You can delete your data at any time, and you can request an export of it, or access to or deletion of it, by emailing privacy@cobaltmere.com. We delete Customer Data within 30 days after you delete your account, except where the law requires us to keep it. Copies in our backups are rotated out and deleted within a further 30 days.

7. Plans and payment

  • Hourmere Cloud will offer a Free plan and paid plans. Paid plans are billed per seat, in advance for each billing period, at the prices shown when you buy.
  • Payments are processed by Stripe. For purchases made through Stripe's merchant-of-record service, your order is sold through Link, LLC, an affiliate of Stripe, which handles payment processing and applicable sales tax, VAT or GST.
  • Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
  • We may change prices for future billing periods with at least 30 days' notice. Price changes do not affect the period you have already paid for.
  • Cancellations and refunds are handled under the Cobaltmere Refund & Cancellation Policy. If your purchase was processed by Link, LLC as merchant of record, Link's refund policy for purchases sold through Link may also apply: you may be able to request a refund from Link under that policy, and where it is more favorable to you than ours, it applies.

8. Acceptable use

You agree not to:

  • use the Service for anything unlawful, fraudulent, deceptive or abusive;
  • send spam or unsolicited messages through booking pages, invitations or notifications, or impersonate another person or organization;
  • access or attempt to access other users' accounts or data, or get around the Service's security measures, rate limits or usage limits;
  • interfere with, disrupt or overload the Service; or
  • resell Hourmere Cloud without our written permission.

We may suspend accounts that break these rules.

9. Third-party services

The Service works with third-party services, such as Google Calendar, Microsoft 365, AI assistants and Stripe. Your use of those services is governed by their own terms, and we are not responsible for them.

10. Availability and changes

We work to keep the Service available, but we do not guarantee uninterrupted operation. We may change or remove features. If we discontinue Hourmere Cloud, we will, where reasonably possible, give at least 60 days' notice and a way to export your data. Shorter notice may be necessary in an emergency or where the law requires it. We will refund any prepaid fees for the period after the Service ends.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, Cobaltmere will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us for the Service in the 12 months before the claim and US$100.

13. Indemnification

To the extent permitted by law, you will defend and indemnify Cobaltmere against third-party claims, and the resulting damages, losses and reasonable costs, including reasonable legal fees, to the extent they arise from Customer Data that you or your invitees submit, from your use of the Service in breach of these Terms or the law, or from actions taken with your API keys. This does not apply to the extent a claim is caused by our own breach of these Terms. We will tell you promptly about any such claim and let you control its defense, and you will not settle a claim in a way that admits fault for us or imposes obligations on us without our consent.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or end your access if you materially breach these Terms. Sections that by their nature should survive termination will survive.

15. Governing law and venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in the State of Delaware, and you and we consent to their jurisdiction. Nothing in these Terms limits rights you have under mandatory consumer protection laws of your country of residence, including any right to bring proceedings in the courts there.

16. General

  • Entire agreement. These Terms, together with the Privacy Policy and the policies they refer to, are the entire agreement between you and Cobaltmere about the Service, and replace any earlier agreements about it. If you have signed a data processing agreement with us, it also applies.
  • Severability. If any part of these Terms is found to be unenforceable, that part will be enforced to the maximum extent permitted and the rest of these Terms will remain in effect.
  • Assignment. You may not assign or transfer these Terms without our written consent. We may assign them as part of a merger, acquisition or sale of all or substantially all of our assets, and will notify you if we do.

17. Changes to these Terms

We may update these Terms. We will post the new version on this page with a new effective date. If the changes are material, we will notify you by email or in the Service at least 30 days before they take effect.
